Purpose of the amendment:
The purpose of the DPA is to review land use policy within the Park Lands Zone of the Adelaide (City) Development Plan to ensure that appropriate public infrastructure projects—such as elements of the O-Bahn City Access Project—can be assessed on ‘merit’, with a focus on selected Policy Areas within the Zone.
The DPA proposes to:
Amend the Desired Character and Principles of Development Control for the Park Lands Zone to actively contemplate public infrastructure projects such as the O-Bahn City Access Project.
Insert additional policy within the Park Lands Zone to support public infrastructure projects.
Amend the 'non-complying' list in the Park Lands Zone to enable the construction of public infrastructure as a 'merit' form of development in the following selected Policy Areas:
- Golf Links Policy Area 16
- River Torrens East Policy Area 18
- Botanic Park Policy Area 19
- Rundle and Rymill Parks Policy Area 20
- River Torrens West Policy Area 24.
Amend the Desired Character for the Park Lands Zone and the Rundle and Rymill Parks Policy Area 20 to actively contemplate future transport infrastructure including a tunnel and pedestrian footbridges.
Amend the Desired Character and Principles of Development Control of the following Policy Areas to provide a more supportive planning policy framework for development associated with an improved O-Bahn City Access Route:
- River Torrens East Policy Area 18
- Botanic Park Policy Area 19
- Rundle and Rymill Parks Policy Area 20.

Mr Mulligan, you mentioned the OBahn project. Minster Rau’s ominous Parkland’s zone amendment to the DPA doesn’t give you the power to take Rymill or Rundle Park for your OBahn project.
It will take a special Act of Parliament.
When will you introduce that Bill to the Parliament and will you call it the Mulligan theft of Rymill and Rundle Park Bill, to be known by the short name as Mulligan’s Folly?

I’m privy to your assertion and it doesn’t require legislation.
The current planning framework provides for an independent assessment of the OBahn project by the Development Assessment Commission.

And we would encourage that and in fact the Development Assessment Commission will encourage people to make their views known there so they can make an unbiased, independent decision about the merits of this project and whether it should be delivered.
And you are probably aware that I have worked very closely with the Adelaide City Council and with residents, particularly in the East End to make sure that we are delivering not just the best possible transport outcome, particularly for the people who live in the North Eastern suburbs who use OBahn services from around and particularly the 3 major interchanges.
But we are doing this in respect of the Parklands and delivering what we need to do as a capital city and that is move as many people into our city and back out again at the end of the day as quickly and efficiently as possible.
QU Minister, with respect, you haven’t answered my question

Qu – You don’t own the Parklands. How would you acquire the parklands?
Mulligan – I’m sorry, you asked if I needed a piece of legislation
QU – No I didn’t - I told you that you needed one.

Question to Mulligan re Legislative Council Select Committee 01/09/2015
Minister- The other question is that, if, as the lady over here said that if it is a fait accompli that the OBahn project is going to proceed, and you said that it is going to start in late December of this year, -
Mulligan – well should we receive a planning consent from the Development Assessment Commission
Question – well then, what relevance does the current Legislative Council Committee that is currently reviewing the OBahn project, have on the process that this is going through?
Mulligan – Well, look, I don’t mean to be disparaging about their efforts, but for these projects we have 2 standing Parliamentary Committees that consider these projects.
We have what is called the Public Works Committee – so every time a Government Agency has to spend more that $4 million dollars on any project, the Parliament’s Public Works Committee considers it , and every time that we have to rezone land for any purpose, the Parliament’s Environment Resources and Development Committee considers it.
So part of this project involves rezoning some land from one purpose to another purpose to enable it to take the OBahn Project.
So those 2 committees are considering or will be considering this project.
So when the Upper House Select Committee - before we made announcements to refinements to the plan was announced – well it is important for those members of the Legislative Council to have a platform, to have their say.
I am sure that there will some people who will want to go and present their views, but those 2 other Parliamentary Committees are what will be considering it and providing their decisions to the Parliament, and then we’ve got the independent Development Assessment Commission which judges this development on its merits.
There is a public consultation process as part of that.
Are both sides of politics on the committee?
The Development Assessment Commission are independent of the planning exercise.
